The judgment of the Constitutional Court (CC) against Jacob Gedleyhlekisa Mhlanganyelwa Zuma is vexatious and nonsensical, by law it is ("ultra-vires") and invalid. It is premature, thus creating a dangerous precedent for similar cases in future. It is common cause that the CC is creature of the Constitution and likewise, the Constitution is a creature of the people. For this cause, it is vexatious and nonsensical for judges of the CC to decide, as to who qualifies to be member(s) of parliament in the National Assembly. In other words, this judgment renders parliament obsolete as a legislative authority. The people are an employer of all judges of the CC. Therefore, this judgment against JGZ is invalid in law, to the extent that should MK wins the forthcoming elections, the CC will be dissolved ANYWAY, making all judges redundant down the hierarchy line. VIVA MK VIVA! VIVA MSHOLOZI VIVA!

Based on the principle of separation of power, the MKP and Zuma legal team knew that, on remission, prospects of success were miniscule. They are, however, making a strong contribution to developing case law in MZANZI. IEC had the locus standi, otherwise law-breakers would be allowed to be elected as MPs, MPLs or councillors. Mind you, it is the IEC that certifies people on the candidate lists elected, depending on the number of seats obtained by their political party. NOT WHEN ONE IS SWORN IN. REMEMBER NOMVULA MOKONYANE and others who resigned from NA before they were sworn-in in 2019? It was always clear that an offence is an offence. It has no different colours. Janet Love merely stated the legal position.

The fact that Zuma is still or will remain on the ballot paper is could be enough to console the MK supporters. It is very unlikely that there will be violence. However we cannot rule out that some comments could be altered that may try to institute or influence some kind of wake up, open your eyes or be active and do not be recipients. I believe most realistic MK members would rather concentrate on campaigning especially that they had just witnessed a very good turn out of the supporters during the last gathering. Why is Gayton McKenzie allowed to go to parliament? He was sentenced to 15 years in jail and served 8 years.
The clause is 5 years if i am not mistaken, so since Gayton's sentence is older than 5 years , he is allowed to be in parliament.
